The Pearl application is developed by Voicekick, Inc. (“Voicekick”) and makes it easy to turn the photos on your phone into engaging narrated videos or “pearls”. Using your voice to narrate your shared photos makes them more compelling, increases authenticity, and creates a stronger bond between you and your friends and followers. Pearl is also a great app for creating short promotional videos for your business that you care share on social media, video services, or wherever you would like. Pearl videos that you share to social media and other services are public. We encourage you to consider whether you want to make your ideas and thoughts public before posting them.

Voicekick is committed to maintaining robust privacy protections for its users. This privacy policy (“Privacy Policy”) is designed to help you understand how we collect, use and safeguard the information you provide to us and to assist you in making informed decisions when using our Site, Products and Services.

For purposes of this Agreement, “Products and Services” refers to Voicekick’s products and services which can be accessed via our website (“Site”) at or through our mobile application(s), including the Pearl application. The terms “we,” “us,” and “our” refer to Voicekick. “You” or “user” refers to you, as a user of our Site, Products and Services. By accepting our Privacy Policy and Terms of Use, you consent to our collection, manipulation, storage, transfer, use and disclosure of your personal information as described in this Privacy Policy regardless of the geographic location of such uses.

  1. Information We Collect.We collect “Non-Personal Information” and “Personal Information.”

    Non-Personal Information includes information that is not associated with your identity, and which is collected cumulatively, such as usage data, general demographic information, location data, platform types, and calculated preferences.

    Personal Information includes your name, email address, preferences you submit, preferences generated based on your interactions with the system, and any other identifying information which you submit to us through the registration process or that is generated based on your use of the Site, Products and Services.

    We store the data we collect for as long as we need it to provide our Site, Products and Services to you. Generally, we retain information associated with your account until your account is closed. Kicks you post may be retained indefinitely, as they may be included in other users’ favorites and playlists. You can access a copy of your personal data and edit your personal data by accessing your Account Settings.

    1.1 Information Collected Via Technology.

    To register to use the Site, Products and Services, you must create a profile by entering your name and email address, creating a user name, and selecting a password. By registering, you are authorizing us to collect, store and use your name and email address in accordance with this Privacy Policy.

    When you use the Site, Products and Services, Voicekick receives information about you through our Site, SMS, applications, APIs, email notifications, ads, paid services, and from our partners and other third parties.

    1.2 Online Tracking.

    To provide and continuously improve our Site, Products and Services, we track information provided to us by your browser or by our software application when you view or use the Site, Products and Services, such as the website you came from (known as the “referring URL”), the type of browser you use, the device from which you connected to the Service, the time and date of access, sites you link to from the Site, Products and Services, your login state, your registration status, your followers, and other information that does not personally identify you. We may track this information using cookies, or small text files which include an anonymous unique identifier. Cookies are sent to a user’s browser from our servers and are stored on the user’s computer hard drive. Sending a cookie to a user’s browser enables us to collect Non-Personal information about that user and keep a record of the user’s preferences when utilizing our services, both on an individual and aggregate basis.

    Voicekick may use both persistent and session cookies; persistent cookies remain on your computer after you close your session and until you delete them, while session cookies expire when you close your browser. For example, we may store a persistent cookie to track your login and account information between sessions.

    Most Internet browsers default to automatically accept cookies. You can change the settings of your browser if you prefer to stop accepting cookies or if you want to be prompted before accepting a cookie. Please note, some of our services may not function properly if you disable cookies.

  2. Use of Information We Collect.2.1 Personal Information

    In general, the Personal Information you provide to us is used to help us communicate with you. For example, we use Personal Information to contact users in response to questions, solicit feedback from users, provide technical support, and inform users about promotional offers.

    We share Personal Information with vendors who are performing services for Voicekick, such as the servers for our email communications who are provided access to user’s email address for purposes of sending emails from us. Those vendors use your Personal Information only at our direction and in accordance with our Privacy Policy.

    We may enable you to access your contacts so that you can invite friends to join Voicekick. This is optional and you can choose whether or not to allow access to your contacts at any time. We may enable you to connect your Voicekick account to your account for another service to facilitate your usage of Voicekick. Such other service may provide us with your registration or profile information and other information you have authorized to be shared. This connection is optional and you can disable it at any time.

    Except as otherwise stated in this Privacy Policy, we do not sell, trade, rent or otherwise share for marketing purposes your Identifiable Personal Information with third parties without your consent, or as reasonably necessary to provide our Products and Services to you, or as we reasonably believe it is required by law, subpoena, or other legal process.

    In the event we undergo a business transaction such as a merger, acquisition by another company, a sale of all or a portion of our assets, or bankruptcy, your Personal Information may be among the assets transferred. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of our assets may continue to process your Personal Information consistent with the terms of this Privacy Policy. If our information practices change at any time in the future, we will post the policy changes to the Site so that you may opt out of the new information practices. We suggest that you check the Site periodically if you are concerned about how your information is used.

    The Site, Products and Services are for the enjoyment of users 13 years old and older. We do not knowingly collect, use or disclose Personal Information from children under the age of 13, or equivalent minimum age in the relevant jurisdiction. If we learn that we have collected the personal information of a child under the age of 13, or equivalent minimum age depending on jurisdiction, we will take steps to delete the information as soon as possible. We do not actively and knowingly direct our users to access third party websites that use, collect or disclose Personal Information of users under the age of 13.     Please note that there are commercially available parental control protections (such as computer hardware, software or filtering services) to assist you in limiting access to material that is harmful to minors. Information about providers of such protections can be found on OnGuard Online.

    2.2 Non-Personal Information

    In general, we use Non-Personal Information to help us improve the Site, Products and Services and customize the user experience. We aggregate Non-Personal Information for analytics services, to track trends and analyze use patterns on our Site, Products and Services. We also aggregate Non-Personal Information for vendors or advertisers, to enable us to offer products, services, advertisements and promotions of interest to our users. This Privacy Policy does not limit in any way our use or disclosure of Non-Personal Information and we reserve the right to use and disclose such Non-Personal Information to our partners, advertisers and other third parties at our discretion.

    We may share cumulative Non-Personal Information such as user profiles, kicks, people you follow, your followers, the number of users who clicked on a link, unique users who saw or clicked on the advertisements of partners or third parties.

    2.3 Third Party Use

    Voicekick works with various partners and third parties to facilitate and improve upon our Site, Products and Services and to provide analytics about the use of our Site, Products and Services. These partners and third parties may collect Personal and Non-Personal Information similar to that collected by Voicekick and may share that information with us. For example, we may work with vendors who host our website, process payments, analyze data, conduct and publish research, measure the effectiveness of advertisements or promotions, provide search results, or deliver relevant advertisements or promotions to you that may be of interest. When we provide information to partners and third parties, they must first agree to only use your information consistent with this Privacy Policy. We do not provide Personal Information to third parties for direct marketing purposes.

    You may disable emailed advertisements and promotions in your privacy settings. Please note that some of the Content on the site may include promoted content and advertising. You cannot opt out of such content.

  3. How We Protect Information.We implement a variety of security measures designed to protect your information from unauthorized access. Your account is protected by your account password and we urge you to take steps to keep your personal information safe by not disclosing your password and by logging out of your account if you use it on a shared device. We further protect your information from potential security breaches by implementing certain technological security measures including encryption, firewalls and secure socket layer technology. However, these measures do not guarantee that your information will not be accessed, disclosed, altered or destroyed by breach of such firewalls, and secure server software. By using our Service, you acknowledge that you understand and agree to assume these risks.
  4. Your Rights Regarding The Use Of Your Personal Information.You have the right at any time to prevent us from contacting you for marketing purposes. When we send a promotional communication to you, you may opt out of further promotional communications by following the unsubscribe instructions provided in each promotional e-mail. You can also indicate that you do not wish to receive marketing communications from us in the “Settings” section of the Site. Please note that, notwithstanding the promotional preferences you indicate by either unsubscribing or opting out in the Settings section of the Site, we may continue to send you administrative emails including, for example, periodic updates to our Privacy Policy or Terms of Use.

  5. Geographic Location of Information.The Personal Information you provide or that we gather is controlled by Voicekick. Voicekick uses Amazon AWS to store data and information, including Personal Information, which will reside on AWS servers in their data centers that are physically located in different regions within the U.S. and potentially even outside the U.S. By using our Site, Products and Services, you consent to your information residing in these locations. If you have any concerns about your Personal Information residing in either location, you should not register or use our Site, Products and Services.
  6. Links To Other Websites.As part of the Service, we may provide links to or compatibility with other websites or applications. Other users may also provide links to other websites or applications. We do not screen the links or content on the linked websites provided by users. We are not responsible for the privacy practices employed by those websites or the information or content they contain. This Privacy Policy applies solely to information collected by us through the Site, Products and Services. Therefore, this Privacy Policy does not apply to your use of a third party website accessed by selecting a link on our Site or via our Products and Services. To the extent that you access or use Products and Services through or on another website or application, then the privacy policy of that other website or application will apply to your access or use of that site or application. We encourage our users to read the privacy statements of other websites before proceeding to use them.
  7. Changes To Our Privacy Policy.Voicekick reserves the right to change this policy and our Terms of Use at any time. We will notify you of significant changes to our Privacy Policy by sending a notice to the primary email address specified in your account or by placing a prominent notice on our site. Significant changes will go into effect 30 days following such notification. Non-material changes or clarifications will take effect immediately. You should periodically check the Site and this privacy page for updates.
