Terms and Conditions
These draft Terms explain how PEARL App may be used, how listings and content are handled, and how platform rules, payments, reports, and complaints work.

1. Platform operator
PEARL App is operated by PEARL APP SRL, CUI 42833600, registered under J40/8733/2020, EUID ROONRC.J40/8733/2020, under Romanian jurisdiction.
The final registered office, general contact email, legal contact email, DSA contact point, accessibility contact, VAT status, and complaint routing details are pending owner/legal confirmation.
Until those details are confirmed, this document must remain in draft status and must not be treated as lawyer-reviewed public legal text.
2. Scope of the service
PEARL App provides a digital platform for discovering, publishing, managing, and interacting with listings, services, content, communication tools, and professional/business resources.
Professionals, companies, academies, and other listing owners are responsible for the services, claims, credentials, prices, schedules, availability, and customer relationships they publish or offer through their listings unless PEARL APP SRL expressly provides a service directly.
3. Accounts and eligibility
- Users must provide accurate registration information and keep account access secure.
- Users are responsible for activity performed through their account unless they promptly report unauthorized access.
- PEARL APP SRL may restrict, suspend, or close accounts that breach these Terms, platform policies, legal obligations, or security requirements.
- Registration requires acceptance of the current Terms and Privacy Policy version shown in the selected language.
4. Listings and professional responsibilities
- Listing owners must publish truthful identity, contact, credential, pricing, schedule, service, course, and availability information.
- Listing owners must comply with consumer protection, professional, licensing, tax, data protection, and sector-specific rules that apply to their activities.
- PEARL APP SRL may review, deny, demote, suspend, remove, or expire listings that are misleading, unsafe, illegal, abusive, or inconsistent with platform rules.
- Top Listing, advertising, paid visibility, or ranking features must be disclosed where they affect visibility or recommendation order.
5. User content and prohibited conduct
Users retain ownership of their content but grant PEARL APP SRL the permissions needed to host, display, moderate, index, translate, and technically operate that content within the platform.
- Do not publish illegal, harmful, misleading, hateful, harassing, sexually exploitative, spam, fraudulent, infringing, privacy-invasive, or unsafe content.
- Do not impersonate others, fabricate credentials, manipulate reviews, abuse reports, automate harmful actions, or bypass platform safety controls.
- Do not upload content that violates intellectual property, confidentiality, personal data, consumer protection, or professional rules.
6. Payments, subscriptions, and paid visibility
- Paid PEARL services, subscriptions, Top Listing placements, vouchers, and payment features must show price, taxes, billing interval, renewal conditions, cancellation method, refund rules, and paid visibility effects before checkout.
- Stripe and Firebase Stripe Payments may process payment and subscription records for paid platform features.
- Where PEARL APP SRL sells directly to consumers, Romanian and EU consumer rights may apply, including mandatory pre-contract information and complaint mechanisms.
- Where a third-party listing owner provides the underlying service, that listing owner remains responsible for its service delivery, pricing, invoice, refund, consumer, and professional obligations unless stated otherwise.
7. Reports, moderation, and DSA-aware process
- Users may report content, listings, reviews, comments, or behavior for policy concerns or alleged illegal content.
- PEARL APP SRL may take proportionate moderation action, including warning, hiding, demoting, removing, denying, suspending, or terminating access to content, listings, or accounts.
- Where the Digital Services Act applies, PEARL APP SRL will separate policy reports from illegal-content notices, process notices diligently, provide required explanations where applicable, and support complaint or appeal flows.
- Romanian DSA and authority-contact details remain pending final legal contact confirmation.
8. Platform scope and accessibility
- PEARL App currently does not provide user-facing AI-assisted features, generated-content tools, AI avatars, or automated support.
- Master and other internal owner-only tooling are separate restricted environments and must not be described as PEARL App user-facing functionality.
- If PEARL App later introduces user-facing AI, automated support, or automated decision-making that affects users, PEARL APP SRL must update the compliance source-of-truth documents, public legal documents, and user notices before release.
- Accessibility contact and service accessibility details are pending final confirmation and must be added before published status.
9. Availability, liability, and changes
- PEARL APP SRL may change, suspend, test, or discontinue features for maintenance, security, legal, business, or product reasons.
- The platform is provided with reasonable efforts, but availability, error-free operation, search ranking, business outcomes, or third-party service results are not guaranteed.
- Nothing in these Terms limits mandatory consumer rights or liability that cannot legally be limited.
- Material changes to these Terms should be versioned and communicated through the platform where required.
10. Complaints, disputes, and governing law
- Support, legal, privacy, DSA, and accessibility contact routes are pending final confirmation.
- Consumers may have access to ANPC and alternative dispute resolution (SAL) routes where PEARL APP SRL sells directly to consumers.
- These Terms are prepared for Romanian jurisdiction and applicable EU law, subject to final lawyer review.
